Brave Semiconductor Corporation, (Brave Semiconductor) warrants to the purchaser of an Brave Semiconductor product (the “Product”) as follows: if the Product is properly used and installed, it will be free from substantial defects in material and workmanship, and will substantially conform to Brave Semiconductor’s warranty specifications beginning on the date the Product was purchased from Brave Semiconductor.
Brave Semiconductor’s warranty specification:
(a) Brave Semiconductor warrants to the original Purchaser that for a period of 1 (one) year from the date of shipment, the Products will be free from defects in material and workmanship, under normal use. If during the warranty period, Purchaser notifies Brave Semiconductor of discovery of any defect, Brave Semiconductor’s sole obligations and Purchaser’s exclusive remedy shall be for Brave Semiconductor, at its discretion, to replace or repair the warranted Products or parts thereof. Products shall be returned to Brave Semiconductor only with prior written authorization from Brave Semiconductor, shipping prepaid. Defective parts may be replaced with either new or factory refurbished or remanufactured parts. The replacement parts shall meet the specifications of the part replaced.
(b) THE FOREGOING WARRANTY SHALL NOT APPLY TO PRODUCTS WHICH:
(1) have been repaired or altered by any party other than Brave Semiconductor-approved employees or designees,
(2) have been subjected to misuses, misapplication, improper maintenance, negligence, accident (including failure of or excessive electric power or failure of environment-control equipment), or
(3) have been used with equipment or parts not approved by Brave Semiconductor,
(c) No repair or replacement shall extend the above warranty periods.
If the Product, which is the subject of this Limited Warranty, fails to conform to the above warranty during the warranty period, Brave Semiconductor, at its option and sole discretion, will:
REPAIR the Product; OR
REPLACE the Product with another product (where the replacement product is an equivalent product at the time a claim for warranty service is made to Brave Semiconductor under this Limited Warranty); OR
CREDIT the then-current value of the Product (at the time a claim for warranty service is made to Brave Semiconductor under this Limited Warranty) towards future purchases from Brave Semiconductor.
THIS LIMITED WARRANTY, AND ANY IMPLIED WARRANTIES THAT MAY EXIST UNDER APPLICABLE STATE, NATIONAL, PROVINCIAL OR LOCAL LAW, APPLY ONLY TO THE ORIGINAL PURCHASER OF THE PRODUCT.
Brave Semiconductor does not warrant that the Product will be free from non-substantial design defects or errors. Further, this Limited Warranty does NOT cover:
THIS WARRANTY REPLACES ALL OTHER WARRANTIES FOR THE PRODUCT AND Brave Semiconductor DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, COURSE OF DEALING AND USAGE OF TRADE. Some states (or jurisdictions) do not allow the exclusion of implied warranties so this limitation may not apply to purchasers in those states (or jurisdictions). ALL EXPRESS AND IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THE LIMITED WARRANTY PERIOD. NO WARRANTIES APPLY AFTER THAT PERIOD. Some states (or jurisdictions) do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to purchasers in those states (or jurisdictions).
This warranty does not cover products purchased through auctions, both on-line and off-line. Sale of discounted merchandise is final and Brave Semiconductor will not provide refund or exchange.
Brave Semiconductor reserves the right to refuse a warranty claim for promotion product or discount product.
Brave Semiconductor’S RESPONSIBILITY UNDER THIS OR ANY OTHER WARRANTY, IMPLIED OR EXPRESS, IS LIMITED TO REPAIR, REPLACEMENT, REFUND, OR CREDIT, AS SET FORTH ABOVE. THESE REMEDIES ARE THE SOLE AND EXCLUSIVE REMEDIES FOR ANY BREACH OF WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY LAW. Brave Semiconductor IS NOT RESPONSIBLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR UNDER ANY OTHER LEGAL THEORY (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, DOWNTIME, GOODWILL, DAMAGE TO OR REPLACEMENT OF EQUIPMENT AND PROPERTY, AND ANY COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH A SYSTEM CONTAINING THE PRODUCT), EVEN IF Brave Semiconductor HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some states (or jurisdictions) do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to purchasers in those states (or jurisdictions). THIS LIMITED WARRANTY GIVES THE PURCHASER SPECIFIC LEGAL RIGHTS, AND THE PURCHASER MAY ALSO HAVE OTHER RIGHTS THAT VARY BY STATE OR JURISDICTION. ANY AND ALL DISPUTES ARISING UNDER OR RELATED TO THIS LIMITED WARRANTY SHALL BE ADJUDICATED IN SANTA CLARA COUNTY, CALIFORNIA, USA AND THE APPLICABLE LAW SHALL BE THAT OF THE STATE OF CALIFORNIA.
All return items must have a RETURN MERCHANDISE AUTHORIZATION (RMA) number issued by Brave Semiconductor. To obtain warranty service, you have to return a defective product, freight-prepaid and insured, to Brave Semiconductor. You must include product identification information, including model number and serial number (if applicable) with a detailed description of the problem you are experiencing.
Once you have obtained an RMA number from Brave Semiconductor, you must, within thirty (30) days, send the product freight-prepaid and insured to Brave Semiconductor. Products shipped to the factory must be properly packaged to prevent damage in transit. You must include the Brave Semiconductor RMA number prominently displayed on the outside of your package and on the shipping label only.
If you send your product to the factory without the RMA number prominently displayed on the outside of the package, it will be returned to you unopened. Customer will be responsible for round-trip freight for RMA.
Brave Semiconductor does not allow customer to collect RMA and accumulate a huge shipment return.
